Acceptance of these Terms
By accessing or using a KISSit.ai website, downloading or installing software, participating in a private beta program, or using any related product or service, you agree to these Terms of Use. If you do not agree to these Terms, do not access, download, install, or use the applicable product or service.
If you access or use KISSit.ai products or services on behalf of a company, organization, government body, or other legal entity, you represent that you have authority to bind that entity to these Terms. In that case, references to “you” include both you and that entity.
Who provides the services
KISSit.ai products, websites, software, branding, documentation, private beta programs, and related services are owned, developed, or operated by T2 Pinans, Inc., unless a specific product notice expressly states otherwise.
Eligibility
You must have the legal capacity to enter into these Terms. If you are below the age of majority applicable in your jurisdiction, you may use KISSit.ai products or services only with the consent and supervision required by applicable law.
You may not use a KISSit.ai product or service if applicable law prohibits you from receiving or using it.
License to use KISSit.ai software
Subject to your compliance with these Terms, T2 Pinans, Inc. grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to download, install, and use KISSit.ai software for its intended purpose.
This license permits use of the software but does not transfer ownership of the software, source code, documentation, branding, or any intellectual property rights.
A specific product, edition, release, installer, private beta package, or distribution may include additional license terms. Those additional terms apply to that product or distribution.
License restrictions
Except where applicable law expressly permits otherwise, you may not copy, sell, rent, lease, sublicense, distribute, publish, commercially exploit, modify, translate, reverse engineer, decompile, disassemble, circumvent technical restrictions, remove proprietary notices, or create derivative works from KISSit.ai software or services without prior written authorization from T2 Pinans, Inc.
You may not represent that you own, operate, endorse, certify, or are officially affiliated with KISSit.ai or T2 Pinans, Inc. unless you have written authorization to do so.
Usage Policy
Your use of KISSit.ai products and services is also governed by the KISSit.ai Usage Policy.
You must use KISSit.ai products and services only for lawful and authorized purposes. You must not use them to compromise systems, distribute malware, evade access controls, conduct fraud, violate privacy, infringe intellectual property, interfere with networks, or facilitate unlawful activity.
If these Terms conflict with the Usage Policy, these Terms control unless applicable law requires otherwise.
Terminal commands and user responsibility
KISSit Terminal Free and other KISSit.ai terminal products provide tools through which you may enter, review, and execute commands on local or connected systems.
You are solely responsible for the commands you enter, paste, approve, or execute and for all resulting effects, including file changes, process execution, software installation, network activity, configuration changes, credential exposure, data loss, service interruption, and effects on connected systems.
You are responsible for reviewing commands before execution, maintaining current and recoverable backups, protecting credentials and sensitive information, confirming that you are authorized to access affected systems, and ensuring that your activity complies with applicable laws, organizational policies, licenses, and contractual obligations.
Accounts, credentials, and access tokens
You are responsible for safeguarding passwords, private keys, certificates, download tokens, access links, authentication credentials, and other security information associated with your use of KISSit.ai products and services.
You must not share personal or restricted access credentials with unauthorized persons. You must promptly notify KISSit.ai if you reasonably suspect unauthorized use of a private beta token or other protected access mechanism.
You are responsible for activity performed through credentials or access mechanisms assigned to you, except to the extent applicable law provides otherwise.
Downloads and release verification
Download availability, supported platforms, architectures, release channels, file formats, checksums, minimum system requirements, installation procedures, and update methods may change as products are maintained and improved.
You are responsible for obtaining KISSit.ai software from an approved KISSit.ai source, checking available release and compatibility information, verifying published integrity information when provided, and following applicable operating-system security guidance before installation.
T2 Pinans, Inc. is not responsible for altered, counterfeit, repackaged, infected, or unauthorized copies obtained from third-party sources.
Private beta programs
Private beta products and services are provided for limited testing, evaluation, and feedback. Beta software may be incomplete, unstable, incompatible, inaccurate, insecure, or subject to material change.
Beta functionality may contain defects, corrupt or lose data, fail to operate, interfere with other software, or be withdrawn without notice. You should not use private beta software for production-critical, safety-critical, or irreplaceable work.
Private beta access is personal to the approved tester unless T2 Pinans, Inc. expressly states otherwise. You may not share protected download links, access tokens, unreleased software, confidential materials, internal documentation, or beta-only information with unauthorized persons.
T2 Pinans, Inc. may modify, suspend, revoke, expire, or terminate private beta access at any time.
Feedback and submissions
You may voluntarily provide suggestions, ideas, feature requests, usability observations, bug reports, test results, or other feedback regarding KISSit.ai products and services.
You grant T2 Pinans, Inc. a worldwide, perpetual, irrevocable, royalty-free, transferable, and sublicensable right to use, reproduce, modify, adapt, distribute, publish, commercialize, and incorporate that feedback into products or services without compensation or attribution.
Do not submit confidential information, personal information belonging to another person, proprietary source code, trade secrets, or material that you do not have the right to provide.
Intellectual property
KISSit.ai names, logos, trademarks, interfaces, documentation, website content, designs, software, source code, compiled code, release materials, and related assets are owned by T2 Pinans, Inc. or its licensors and are protected by applicable intellectual property laws.
No right, title, or interest is granted to you except for the limited rights expressly provided in these Terms.
Open-source components included in or used by a KISSit.ai product remain subject to their respective licenses. Nothing in these Terms limits rights expressly granted under an applicable open-source license.
User-provided content and information
You retain ownership of content and information that you lawfully provide through support, feedback, private beta, or other approved submission channels.
You grant T2 Pinans, Inc. the limited rights reasonably necessary to receive, store, reproduce, review, process, and use that material to provide support, investigate issues, secure the service, administer beta programs, and improve applicable products and services.
You represent that you have the necessary rights and permissions to provide submitted material and that doing so does not violate applicable law or another person’s rights.
Third-party products and services
KISSit.ai products may interact with operating systems, shells, command-line utilities, package managers, source-code repositories, websites, application programming interfaces, networks, cloud services, or other third-party products and services.
Third-party products and services may impose separate terms, licenses, privacy practices, technical requirements, usage restrictions, or fees.
T2 Pinans, Inc. does not control and is not responsible for third-party products, services, content, availability, security, accuracy, or conduct. Your use of third-party products and services is at your own risk and is governed by the applicable third-party terms.
Privacy and personal information
The KISSit.ai Privacy Policy explains how personal information may be collected, used, retained, protected, and disclosed in connection with KISSit.ai websites, downloads, private beta programs, support, feedback, and related services.
You must not submit personal, sensitive, confidential, privileged, or regulated information through KISSit.ai forms or support channels unless the information is necessary for an approved purpose and you are authorized to provide it.
Security
T2 Pinans, Inc. may implement technical and organizational safeguards intended to protect KISSit.ai systems and information. No website, software product, transmission method, or storage system can be guaranteed to be completely secure.
You must not attempt to bypass security controls, gain unauthorized access, disrupt infrastructure, test vulnerabilities without authorization, extract protected information, or interfere with another person’s use of KISSit.ai products or services.
Suspected security vulnerabilities should be reported through the process described on the KISSit.ai Security page.
Product and service availability
KISSit.ai products and services may be updated, modified, limited, suspended, discontinued, replaced, or withdrawn at any time.
Features, compatibility, performance, release schedules, download availability, support availability, service capacity, and continued operation are not guaranteed.
Maintenance, security events, infrastructure failures, third-party failures, legal requirements, internet conditions, natural disasters, labor disruptions, or circumstances beyond reasonable control may interrupt availability.
Updates and modifications
T2 Pinans, Inc. may release corrections, security updates, compatibility updates, feature changes, or new versions of KISSit.ai products.
An update may modify or remove existing functionality. Continued use of an updated product may require acceptance of revised terms or installation of a supported release.
You are responsible for reviewing release information and maintaining software versions appropriate for your environment and security requirements.
No professional advice
KISSit.ai products, websites, documentation, examples, command suggestions, and other content are provided for general informational and productivity purposes.
They do not constitute legal, financial, accounting, tax, investment, cybersecurity, compliance, medical, engineering, or other professional advice. You should obtain qualified professional advice when appropriate.
Disclaimers
To the maximum extent permitted by applicable law, KISSit.ai products and services are provided on an “as is” and “as available” basis, with all faults and without warranties of any kind, whether express, implied, statutory, or otherwise.
T2 Pinans, Inc. disclaims, to the maximum extent permitted by law, implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, compatibility, and security.
T2 Pinans, Inc. does not warrant that KISSit.ai products or services will be uninterrupted, error-free, secure, compatible with every system, suitable for every purpose, free from harmful components, or capable of preventing data loss or unauthorized access.
Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, exclusions apply only to the extent permitted by applicable law.
Limitation of liability
To the maximum extent permitted by applicable law, T2 Pinans, Inc. and its directors, officers, employees, contractors, affiliates, licensors, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
This exclusion includes loss of data, files, credentials, profits, revenue, business opportunities, goodwill, productivity, expected savings, system availability, or access to products or services arising from or related to KISSit.ai products, services, downloads, software, beta programs, or these Terms.
Where liability cannot lawfully be excluded, the total aggregate liability of T2 Pinans, Inc. arising from or relating to the affected product, service, or these Terms will not exceed the amount you paid directly to T2 Pinans, Inc. for the affected product or service during the twelve months preceding the event giving rise to the claim, or PHP 1,000 if you paid no amount.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.
Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless T2 Pinans, Inc. and its directors, officers, employees, contractors, affiliates, licensors, suppliers, and service providers from claims, proceedings, losses, liabilities, damages, judgments, penalties, costs, and reasonable legal fees arising from your unlawful or unauthorized use of KISSit.ai products or services.
This obligation also applies to claims arising from your violation of these Terms or the Usage Policy, your violation of applicable law, your infringement of another person’s rights, or content and information that you submit.
Suspension and termination
T2 Pinans, Inc. may restrict, suspend, or terminate access to websites, downloads, private beta programs, access tokens, software services, support channels, or related systems when reasonably necessary to enforce these Terms, protect users or infrastructure, investigate suspected misuse, preserve evidence, comply with law, or protect legal rights.
You may stop using KISSit.ai products and services at any time.
Upon termination, rights granted under these Terms end immediately. Provisions that by their nature should survive termination will remain effective, including provisions concerning ownership, feedback, disclaimers, liability, indemnification, governing law, and dispute resolution.
Compliance with laws
You are responsible for complying with all laws, regulations, court orders, sanctions, export controls, import restrictions, licenses, and industry requirements applicable to your use of KISSit.ai products and services.
You may not use, export, re-export, transfer, or provide access to a KISSit.ai product where doing so would violate applicable law.
Governing law and jurisdiction
These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles.
Subject to rights and remedies that cannot lawfully be waived, disputes arising from or relating to these Terms or KISSit.ai products and services will be submitted to the competent courts of the Republic of the Philippines.
Changes to these Terms
T2 Pinans, Inc. may update these Terms to reflect changes in products, services, operations, security practices, business requirements, laws, or regulations.
The current version will identify its effective date and last-updated date. Material changes may also be communicated through the website, software, email, or another appropriate notice mechanism.
Your continued use of an affected product or service after revised Terms become effective constitutes acceptance of the revised Terms. If you do not agree to a revision, you must stop using the affected product or service.
Severability
If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or modified only to the extent necessary to make it enforceable.
The remaining provisions will continue in full force and effect.
No waiver
A failure or delay by T2 Pinans, Inc. to exercise or enforce a right or provision under these Terms does not waive that right or provision.
A waiver is effective only if expressly made in writing by an authorized representative of T2 Pinans, Inc.
Assignment
You may not assign or transfer your rights or obligations under these Terms without prior written consent from T2 Pinans, Inc.
T2 Pinans, Inc. may assign or transfer its rights and obligations in connection with a merger, reorganization, acquisition, sale of assets, corporate restructuring, or transfer of the applicable product or service, subject to applicable law.
Entire agreement
These Terms, together with the Privacy Policy, Usage Policy, and any product-specific, download-specific, license-specific, or beta-specific terms presented to you, form the agreement governing the applicable KISSit.ai product or service.
They supersede prior or contemporaneous communications and understandings concerning the same subject matter.
